Ordering Method

1.Online orders and e-mail order shall be accepted.
2.When you place order, please indicate the correct number of item, size, and the side of the hand used, country, address, contact number and name for our information and action.
3.Seller will reply you the transportation fee for your order within 3 days.
4.The payment should be settled within 7 days after our information.
5.The date of dispatch depends the content of buyer’s order. It will confirm in our reply of the transportation fee. We will not guarantee the date of dispatch if the payment period is over the item 4.
6.Seller will not direct supply to the country, which has our solo agent.
7.The amendments to be accepted only before package closed or the production of special item started.

General terms and conditions of EPEE (Enlighten Power Escrime Equipment)

Definitions:

As used in these General Terms & Conditions of Sale, the term goods shall mean the products, equipment, fencing accessories and other tangible property from time to time sold of offered for sale by Seller; the term service?shall mean the labor from time to time provided by Seller; the term ?Seller? shall mean the entity selling or offering such Goods or Services; and the term “Buyer?shall mean the person to whom such Goods or Services is sold or offered.

Other terms:

If this is an acceptance or written confirmation, it is expressly made conditional upon your assent to any terms contained herein that are additional to or different from those of your offer. If this is an offer, your acceptance hereof is expressly limited to the specific terms contained herein. These General Terms and Conditions of Sale shall contain all of the terms applicable to any sale of or offer to sell Goods or Services. Seller specifically objects to any additional or different terms contained in sellerbsite www.ggg.com.hk terms?used by Buyer. Any acceptance of Goods or Services by Buyer or any payment by Buyer of any part of the purchase price shall be deemed to be a waiver of any additional of different terms contained in Buyers documents and an acceptance of all of the General Terms and Conditions of Sale, notwithstanding the acknowledgement by Seller of Buyer's purchase order or other document provided by Buyer. No order for Goods or Services shall be binding on Seller until it is acknowledged in writing or verbal or electronic mail by Seller.

Price:

Unless otherwise stated, all prices are FOB Shanghai in United State Dollars. (In case of delivery within Shanghai boundaries) No amount is included in any price for sales, use, privilege, excise or other taxes imposed on or measured by the gross receipts from the sale of the Goods or Services. Buyer shall promptly pay any such charge directly to their local government authority assessing them or reimburse on demand any such charges paid by Seller. For other currency, please be informed that the price will be fluctuating a little bit according to the change of exchange rate with United State Dollars.

Payments:

All payments shall be in advance by Bank remittance or Credit Card before delivery in Euro Dollars without offset, back charge, retention or withholding of any kind. Buyer shall pay Seller the full price of the products or any balance thereof before the delivery of the products. Liability Certificate payment is only accepts of the total amount over EURO 7,500 and agrees of seller. If the balance of the price is not paid by the Buyer upon delivery of the product, Seller shall be entitled to forfeit the deposit paid by the Buyer and withhold the delivery of the products. Post-dated cheque would not be accepted. Bank remittance payment, the bank charge of the Bank remittance payment shall be response by buyer. Credit Card payment, EURO 3 and 2.8% of the total amount extra charge shall be added for the Paypal services. The partial payment shall not be accepted.

Delivery:

Delivery to the carrier, notification that Goods are ready for shipment shall constitute delivery to Buyer for all purposes. The term of delivery depends on the applied mode of delivery and its destination. The date of dispatch depends on the quantity of ordered goods and the buyer requirements. Seller reserve the right to part-deliveries.

Shipment:

Prices include the cost of packing. Freight charges do not include any price unless otherwise stated at specific order values. Seller shall have a right to charge delivery charges without prior notice to Buyer. In the event that any Goods will be shipped out of the Shanghai region, all fees and expenses relating to export documentation, packing, marking or importation into the country of destination shall be the responsibility of Buyer.

Acceptance:

All Goods shall be finally inspected and accepted within 48 hours after delivery. All Services shall be inspected and accepted within 48 hours after they are performed. Failure of Buyer to provide Seller with an itemized list of defects within such seven (7) days or to provide Seller a reasonable opportunity to correct any listed defects shall be deemed acceptance of the Goods or Services. In the event of multiple shipments or extended Services, each individual shipment shall be separately accepted and Services shall be periodically inspected and accepted. Buyer expressly waives any right to reject Goods or Services that substantially conform to the specifications relating thereto and any right to revoke acceptance after such 48 hours period.

Delays:

Seller shall have no liability for any failure to delivery the Goods or perform Services to Buyer if such failure arises from causes beyond the reasonable control of Seller, including but not limited to, delays of suppliers or carriers, government actions, shortages of materials, strike, fires, floods, act of God and the effects of civil disobedience.

Changes:

Seller reserves the right to change the details of any Goods provided that such change shall not impair the performance or critical dimension of such Goods.

Additional costs:

In addition to the purchase price, Buyer shall pay to Seller any costs incurred as a result of (a) changes in the Goods or Services or delays in delivery requested by Buyer; (b) delays in delivery arising from Buyer’s failure to provide information, drawings or materials; (c) changes in the laws, codes, rules or regulations applicable to the Goods or Services after the date of quotation by Seller.

Warranty & Guarantee:

To the extent that Goods are warranted by sellers or their original manufacturers, and to the extent that such warranties are assignable to Buyer, Seller assigns to Buyer any rights and remedies relating to such Goods. Sellers further agrees to perform any obligations of the original manufacturer under the manufacturer's warranty to the extent that such manufacturer authorizes Seller to perform such warranty obligations. Seller warranty Goods manufactured and Services performed by it pursuant to the warranty policy statement issued from time to time by Seller. Except as set forth in the applicable warranty policy statement, Seller makes no warranty, express or implied with respect to Goods or Services including any warranty of merchantability or fitness for a particular purpose. The three months and 1 year guarantee for the fencing equipment and FIE fencing machines supplied and distributed by Epee Co. Ltd from the date of purchase.

A. The coverage for the case:
If the goods purchased are manufacturing and material defects during the guarantee period If buyer received the defective goods, the buyer should inform seller within 48 hours for replaced, but the goods must not be used. If the defects occurring during the guarantee period will be repaired if they are repairable, if not, then replaced. Our guarantee obligation ends if the Buyer does not preserve or make available the defective goods in their defective state.

B. The guarantee does not cover the following cases:
1.Unprofessional and careless handling
2.Overstraining
3.Defective mounting
4.Defects caused by radical washing agents and not keeping to the wash instructions
5.Special terms:
i.There is no guarantee period on the breakage of fencing blades. Their replacement covers only their material defects.
ii.The fencing blades stored in humid environment get oxidized.
iii.The electric jackets made of non-washable material depending on its usage would oxidize in the course of time.
iv.Also the foil of the non-FIE-masks and non-FIE-sabre cuffs can get oxidized.
v.Complaints connected with the selleraring of the sole of fencer's shoes or of their leather surface are not accepted.
vi.The jamming of the fencing spool cable or dirty contacts are not defects.
vii.Seller do not accept complaints connected with injuries occurring on the fencing piste, caused by the unprofessional mounting and de-mounting.

Exchange of products:

Any product purchased could be exchanged only against product. Any cost occurring in connection with such an exchange (delivery, packaging etc.), rests upon the buyer. Only unused products could be exchanged. Except the case when the size, product delivered by us does not correspond to the order or the product has some defect. In this case occurring costs are paid by our side.Tailored, extra large outfit/clothing, name printed or national color painted uniform could not be exchanged. According to this, please indicate accurately the size when ordering.

• Product alteration: Seller reserve the right at all times to make changes to our products. To follow these seller draw your attention to our website and catalogue.
• Further sale: to sell the goods bought from us to a third country, the buyer should previously inform us to receive our approval.
• Blades: bend, flexibility, hardness of the blades may differ a little bit within the determined standards.
• Colors: Colors of the goods in their real appearance may vary a little bit from the printed catalogue or website colors. There could be slight color differences between two productions series (for example: blades, grips, leather, name, national colour printing or PVC covers). The design, color of the clothings or fencing bags maybe adjusted to the trend.

Cancellation:

Orders for Goods or Services may not be cancelled by Buyer after acceptance by Seller. Seller shall be entitled to request for reasonable assurances that Buyer will accept and pay for any Goods or Services, including but not limited to requiring payments on account or in advance, if there are reasons to believe that Buyer will not accept and pay for Goods or Services when delivered. Until such assurances are received, Seller shall be entitled to stop work on the Goods or Services , cancel any agreement to sell the Goods or Services, sue to recover the purchase price or any expenses incurred to the date of cancellation, resell the Goods or Services to a third party, or exercise any remedy available at law or in equity for breach of contract.

Title of Goods:

Title to the Goods shall remain vested in Seller until Seller has received full payment of the price and risk shall pass to the Buyer upon delivery of the Goods.

Interpretation:

Any sale or agreement to sell Goods or Services shall be interpreted according to the laws of Hong Kong Special Administrative Region of the People’s Republic of China (Hong Kong?, excluding any provision thereof that would direct the application of the laws of another jurisdiction. Buyer agree that any sale of or agreement to sell Goods or Services will be deemed to be made and performed solely in the courts of Hong Kong to the exclusion of all other jurisdictions.

Limitation of liability:

Neither Seller or Buyer shall have any liability to the other for any incidental or consequential damages arising from the sale of Goods or Services or the failure of either party to fully perform any agreement to sell Goods or Services. Seller shall have no liability for any loss, damage or cost arising from the failure to discover or repair latent defects or design defects in any Goods or Services. Buyer specifically waives to the maximum extent permitted by law, any claim for incidental, reservoir, special, indirect, consequential and exemplary damages, including but not limited to multiple damages under any deceptive trade practice or consumer protection laws.

Waiver:

The waiver by either Seller or Buyer of any breach under these General Terms and Conditions of Sale shall not be deemed to be a waiver of any subsequent breach of a like or different nature. The failure to enforce any provision of the General Terms and Conditions of Sale shall not be deemed a waiver of such provision.

Arbitration:

Any dispute arising from or relating to the sale of Goods or Services, including the interpretation of these General Terms and Conditions of Sale shall be resolved by binding arbitration according to Arbitration Laws of Hong Kong.

Indemnity (including for negligence):

Buyer hereby assumes and agrees to indemnify, defend, protect, save, keep and hold harmless Seller, its agents, employees, subcontractors, any invitees from and against and any losses, damages, injuries, claims, causes of action, liabilities, demands and expenses (including attorney fees and other legal expenses) of whatsoever kind and nature, for injury to, or illness or death of any person and for all damage to, loss or destruction of property (collectively losses) relating to, connected with, arising out of, or on account of the Goods or Services purchased hereunder, including without limitation, any such losses caused or occasioned by any negligent act or omission of Seller, its officers, agents, employees, subcontractors, invitees or licensees. The forgoing indemnity is a material part of this transaction, supported by and in consideration of a reduction in the purchase and is intended to apply notwithstanding the joint or concurrent negligence of Seller.

Risk of Loss:

Seller shall bear the risk of loss of the Goods until Goods are delivered to the carrier including carriers owned or controlled by Seller or notification to Buyer that the Seller is ready for shipments whichever occurs first. Thereafter, Buyer shall bear the ntire risk of loss of the Goods.

Entire Agreement:

These Terms and Conditions of Sale constitute the entire agreement of the parties and supersede all discussions, arrangements, negotiations, representations and warranties, if any relating to the Goods or Services covered hereby.
